Weapons Prohibited

No weapons are permitted on the property at any time. This includes firearms, ammunition, knives intended for use as weapons, explosives, tasers, pepper spray, and any other item that management determines may endanger guests, staff, or property. This policy applies to all guests, visitors, vendors, contractors, and employees, regardless of any license or permit. Any person found with a weapon on the property may be denied entry, removed from the property without refund, and referred to law enforcement.  Property includes, but is not limited to, any physical property (including accommodations, restaurants, and common areas) and vehicles (boats, vans, golf carts).

Tours

Arrival

Please arrive 15 – 20 minutes prior to scheduled departure.  If your departure is from your place of lodging, please be prepared to leave 15 – 20 minutes prior to your scheduled time.  We cannot be held responsible for tours missed or incomplete due to late arrivals.

Minimum Number Required

Each tour or activity has a minimum number of guests required to book.  If your party is less than the minimum number required to confirm the tour, you will be allowed to make a tentative reservation.  We will contact you 24 hours prior to the scheduled start date to confirm or attempt to reschedule your activity.

Children’s Rates

On most tours, the following children’s rates apply:

• Age 1 and under – free
• Age 2 – 5:  $20 USD per child, per tour plus 12.5% GST
• Age 5- 10:  50% off published adult rate
• Age 11+:  full rate applies

Child rates do not apply to diving, ATM, ziplining, chocolate farm, horseback riding and possibly others.

Dates and Availability of Activities Not Guaranteed

While we make every effort to ensure tours are held on the date requested, a variety of factors may require a change. Circumstances including, but not included to, weather and availability of guides and/or resources may impact the date requested. If the availability of your date changes, we will contact you as soon as possible and your tour will be rescheduled to a new date. If rescheduling is not an option, you may be offered credit towards another tour or a refund of any deposit paid.

Weather Advisories / Partial Tours

Sometimes weather conditions may make a tour permissible but not advisable.  If we advise that your tour may not be completed due to pending weather, we will offer to reschedule to another day or suggest an alternative activity.  If you elect to begin the tour, no refund or exchange will be made available if the tour is unable to be completed due to weather or conditions of nature.

Cancellation by Us

We reserve the right to cancel any tour prior to departure date for any reason including, but not limited to, insufficient number of participants, weather, or unavailability of equipment or guides.  If that happens, we may offer an alternate date or activity of equal value.  If you choose not to accept the alternatives, all refunds will be made accordingly and without further obligations.  We shall not be held liability for any contingent costs incurred by you arising from the cancellation.  You will receive a refund within 45 days following the scheduled departure date.  We will not be liable for any claims, losses, damages, or costs sustained by you.

Golf Cart Policies

A $250 USD fine (unless otherwise noted) is immediately applicable to your credit card/cash deposit for the following violations:

• Driving the rental on private property
• Driving the rental on airport runway
• Driving the rental on public beaches and on the sidewalk
• Allowing the rental to be operated by an unauthorized driver
• Overloading the rental
• Rental must be returned with a FULL TANK OF GASS. If the rental is returned less than full, we will fill the rental on your behalf and you will be responsible for the cost of gas plus a service charge of $2.50 USD.
• Cable lock and key must be returned at end of rental period,  Failure to do so will result in a charge of $20 USD per item (cable lock and key).
• Renter is liable for the first $500 USD in damages + any additional costs (see #4 below)

Rental must be returned to Captain Jak’s in the same condition, with the same equipment and with the same amount of fuel with which it was rented to you. You agree that this rental will not be used in any manner that represents a violation of this agreement or the laws of this country. Violations of the rental agreement include, but are not limited to:

• Allowing unauthorized drivers to operate the rental.  The only authorized drivers are the renter or additional drivers who are listed above.  All drivers must have and carry with them at all times a valid driver’s license and be at least 21 years of age.
• Operating the rental under the influence of alcohol or drugs (prescription or otherwise).
• Operating the rental for any use other than its intended purpose.
• Operating the rental in violation of the laws of Belize.
• Driving the rental off the peninsula, this terminates at The Placencia Hotel.
• Obtaining the rental by providing false information.
• Using the rental for illegal or improper use.
• Leaving the rental unattended, unless the key is removed, the rental is parked & locked to the steering wheel, in a safe location.
• Running the rental dry of essential oils, fluids & water, potentially causing excessive damage.
• Operating the rental on any surface not intended for vehicular use.
• Overloading the vehicle. Maximum vehicle loads are as follows: 4-seater golf carts (4 people); 6-seater golf carts (6 people).

The renter agrees that Captain Jak’s is not responsible for loss or damage to personal property of the renter or passengers during or after the use of the rental.

The renter agrees to pay all applicable charges arising from this agreement including, but not limited to:

• Overdue charges of $15.00 USD per hour for the first 2 hours after which the cost of an additional day applies.
• A $30.00 USD fee if the rental is returned to another location other than the rental location unless prior arrangements are made. Location will be confirmed with Captain Jak’s on first day of rental.
• All costs arising from parking & traffic violation while the vehicle is rented to renter.

The renter is liable for the first USD $500.00 in damages to the rental, plus loss of income resulting from such damage & any additional charges & cost arising after a final audit of this agreement up to and including the full replacement of entire vehicle. A valid credit card must be placed on file to guarantee the rental. 

The renter agrees to not make any repairs or adjustments on the rental without Captain Jak’s expressed authorization.

The renter shall report all accidents to the police and Captain Jak’s immediately.

Captain Jak’s will not be responsible for the loss of life or personal injuries arising from accidents or otherwise.

The renter agrees to these additional provisions:

• I am the renter of the vehicle only & am not Captain Jak’s agent or representative for any purpose.
• Captain Jak’s is not responsible for any damages, direct or coincidental, resulting from the performance or non-performance of the vehicle.

This agreement shall be interpreted & enforced in accordance with the laws of Belize. By signing this contract, I hereby authorize Captain Jak’s to charge my credit card (an imprint of which has been signed by me) for any damages incurred, fuel used or additional time if the rental is not returned by the agreed time.  I agree that any of these expenses incurred & charged to my credit card are final & that I shall not employ the service of my credit card company as means of settling any dispute related to this matter.  

Accommodation Policies

POLICIES

• Accommodations will be used as a residence ONLY. Occupancy is not to exceed the sleeping accommodations as advertised according to the beds within the property.
• It is understood and agreed that the owner, or agent, of said premises shall have the right to enter and inspect premises at all reasonable times to insure maintenance and safety of the premises and to show the condominium to prospective tenant or buyer by specified appointment and shall not be held liable for any injury, theft or loss to said tenant.
• Rates quoted are in US Dollars per night/week.
• An additional 9% hotel tax applies to the rental rate only.
• We accept Visa, MasterCard, Discover and American Express credit cards.
• Reservations can be made in advance up to 365 days from arrival date to a minimum of 48 hours from arrival date.
• Transfer of Funds:  Please note that in the instance a credit is given for cancelled tours, this credit may only be used at Captain Jak’s and cannot be transferred to any other business, resort, hotel, or accommodations.
• Deposit: A deposit of 50% of the total rate for bookings is required to confirm a reservation. No reservation is confirmed until proper payment is received.
• Balance: Final balance is due 30 days prior to arrival date.
• Late Bookings: Bookings made within 30 days prior to arrival are payable at the time of booking.

General Policies

Prices

Prices quoted are in USD and do not include GST of 12.5%.

Cancellation by You

We understand that your plans may change. If you need to modify or cancel your tour, golf cart reservation, or lodging, please contact us as soon as possible. Should you need to cancel or reschedule a tour, we will first attempt to reschedule your tour to a different day.  If that is not an option, we may offer alternative tours.  If you contact us after the scheduled start of your tour or do not show up for your scheduled tour, no refund is available.  If you cancel and do not replace the tour, golf cart reservation, or lodging reservation, a refund (less any fees) shall be offered in accordance with this schedule:

• Notification of 30 days or more prior to your scheduled tour date: full refund of any deposit paid less 10% fee
• Notification of 15 days or more prior to your scheduled tour date: refund of deposit paid less 50% fee
• Notification of 7 days or more prior to your scheduled tour date: refund of deposit paid less 75% fee
• Notification of less than 7 days: no refund available

Reservation agreements shall be interpreted & enforced in accordance with the laws of Belize. By making any reservation, I authorize Captain Jak’s to charge my credit card as scheduled.
